Out-of-Court Divorce Options:
3-Meeting Divorce and/or Parenting Plan
This is a perfect option when you both agree that you would like to divorce and/or determine a parenting plan amicably, but you wish to avoid the paperwork, financial and emotional strain, and overall burden of a traditional divorce. This is a great option if you know somewhat how you would like to divide assets or share custody, but need additional help ironing out the details. Let us handle it for an affordable fee. Our process usually takes just three, 1-hour, visits. These can be in person or by zoom.
After the first meeting, we will discuss your situation, and you’ll be given a bit of homework. During the second and third meetings, we will discuss various settlement options and parenting plan proposals, and answer your questions that come up during the process.
Once you've helped us identify your wishes, we handle all the paperwork and provide you with a package to simply sign and drop off with the clerk without having to set foot in the courtroom.
Rachel can serve clients throughout Montana with both in-person and virtual meetings.

Mediation
Mediation is appropriate for families who know they do not want to get swamped by the divorce process, do not want to go to court, but don’t agree on everything. With the help of a neutral attorney mediator over the course of a few short meetings, couples can gracefully work through the issues at hand to come to an agreement that works best for everyone.
By agreeing to hire one attorney jointly as your mediator, you will save on the costs of hiring separate attorneys, and can easily avoid the conflict and heartache that accompany an adversarial process. Once an agreement is reached, we will provide you with a fully drafted divorce package to sign and drop off with the clerk for the Court’s signature.

Avoiding Litigation
Litigation may not be the best method to resolve disputes between parties. The process can be expensive, cause further damage to once-valued relationships, and can ultimately fail to resolve the issue litigated with a solution that is workable for the parties.
Mediation is the process of using a neutral third party to help elicit each party’s goals and needs, and to help brainstorm solutions that are reasonable and work for everyone, without going to court.
Evaluative mediation with a family law attorney will also provide both parties with feedback and direction on what solutions the court would expect to see and what types of agreements are reasonable under Montana law.
